Insa advokater assists Norwegian trustees who have been appointed in cases with links to Pakistan. We assist in probate cases in connection with both inheritance settlements and divorces. Examples of cases we can assist with are where the deceased has assets and heirs in Pakistan, and where the deceased was resident in Pakistan but has assets in Norway. See more info in the q&a's below.
We can assist in mapping assets in Pakistan, including conducting the necessary investigations to locate property and other assets and documentation of ownership. We can also help verify documents, assist with DNA testing, obtain confirmation of marriage information via the public authorities in Pakistan, etc.
Our permanent local legal liaison in Pakistan is Rao & Virk LawFirm(www.rao-virk.com), and this firm is engaged to carry out local work under our management. Throughout much of the year, one of our Norwegian lawyers is in Pakistan to follow up on cases.
You will always be given a maximum price and a maximum number of hours for the assignment, both for the work performed by our Norwegian lawyers and the work performed by our lawyer connection(www.rao-virk.com) in Pakistan. This means that you will never pay more than the maximum price stated in the quote. If we spend less time than estimated, you will of course only pay for the time we work.
The hourly rate is NOK 2000 ex VAT for work performed by Norwegian lawyers. For work performed by our Pakistani lawyers, the hourly rate is NOK 200 ex VAT. Expenses will be added.
Our lawyer in Pakistan collects biological material from the children and sends it to Ullevål University Hospital for examination. This makes it possible to confirm or deny paternity in cases where the deceased has potential heirs in Pakistan who are not registered in the National Register in Norway.
Depending on the type of asset, we will initiate an investigation. For example, if it is a property in Pakistan, we will first check the public property registers or the local public property offices. If necessary, we will eventually need to locate the property to obtain information about the property.
An inheritance settlement is carried out by issuing a Succession Certificate/Letter of Administration. The probate certificate establishes the ownership of the heirs.
A probate certificate is issued either via Nadra, an administrative body, or through a court process.
Nadra can issue a probate certificate within 14 days if all the necessary documentation has been submitted and there are no disputes between the heirs. If the process is conducted through the court, it normally takes between 3 to 6 months to issue a probate certificate.
After the decision has been made, the heirs can dispose of the properties.
The heirs and the deceased must have valid Pakistani ID documents (passport/POC) in order for Nadra to issue a probate certificate.
The price you receive from us is always a maximum price. The price for an inheritance settlement depends on several factors, including the number of assets included in the estate, the type of assets, jurisdiction, whether there is a dispute between heirs, whether you have to spend time finding assets and heirs, etc. The inheritance settlements we have carried out in Pakistan on behalf of our clients in Norway have cost between NOK 20-50,000.
Under Pakistani law, inherited assets cannot be disposed of until a formal probate settlement has been completed in Pakistan. In practice, however, the heirs can use real estate and other physical assets pending the probate settlement, but bank deposits are blocked until the inheritance settlement is completed under Pakistani law.
No, there is no limitation period for requesting a probate certificate or carrying out a probate settlement.
