If you wish to divorce and still live together, you must first apply for separation and live apart for one year. You must be separated for one year before you can file for divorce. If you have lived apart for more than two years, you can apply for divorce directly.
Mediation is a process where a neutral third party (a mediator) helps the spouses communicate and find solutions to conflicts and disagreements, for example around child custody, finances and assets. Mediation is required when the spouses have joint children under the age of 16 and must be completed before a divorce can be granted.
In the event of a divorce, the spouses' assets are divided. Each spouse's net assets (assets minus debts) are calculated and added together. The total net assets are then divided between the parties. The spouses may agree on a different division of assets and debts, or they may have entered into a prenuptial agreement that regulates this.
The spouses agree on where the children will live permanently and what access arrangements will apply. If the spouses cannot agree, they can seek help from a mediator or a family welfare office. If it is still not possible to reach an agreement, the case can be taken to the courts, which will decide on child custody and access rights based on what is best for the child.
Child support is a financial contribution from the parent who does not have the children living with them to the parent who has the children living with them. Child support is intended to cover expenses for the child. The amount of the contribution is determined on the basis of both parents' income, the extent of access and the child's needs.
Spousal maintenance, also known as partner maintenance, is a financial contribution that one spouse may be obliged to pay to the other spouse after a divorce or separation. The purpose of spousal maintenance is to ensure that the spouse with the weaker finances has a transitional period during which they can adapt to the new financial situation and become self-supporting.
Spousal maintenance can be claimed if one of the spouses has a special need for financial support after the divorce and the other spouse is able to pay the maintenance. Several factors play a role in the assessment: the financial situation of the spouses, how long the marriage lasted, age and health, the ability of the recipient to support himself or herself, and the ability of the other spouse to pay the contribution.
